Super Bowl Sunday 2014 and Sacramento Open Houses

Super Bowl SundayHome buyers in Sacramento were out in droves over the weekend, attending open houses, touring new listings and writing offers. This was the one weekend in January to do it because we got a break in those football games. Granted, I am not a person who watches football. I am probably in the minority but football doesn’t interest me. Not even if I imagine the team players as short sale negotiators at various banks — oh look, Bank of America just swiped the ball from Green Tree, and Wells Fargo bashed PNC in the head.  Nope, still doesn’t do it for me.
Next weekend, of course, will be Super Bowl Sunday 2014, and it’s just not a good weekend for an open house. Oh, sure, there are Super Bowl widows and widowers who will be out and about, but the bulk of Americans will be focused on who will win the Super Bowl. Big Super Bowl parties everywhere except at my house. I’m not even sure who is playing, I think Denver and . . . After we get past this next weekend, it should be clear sailing through spring into summer for ...Sacramento real estate.

Advance planning for incapacity - Alzheimer's Disease.



Advance Planning Can Help Relieve the Worries of Alzheimer’s Disease

The “ostrich syndrome” is part of human nature; it’s unpleasant to observe that which frightens us.  However, pulling our heads from the sand and making preparations for frightening possibilities can provide significant emotional and psychological relief from fear.

When it comes to Alzheimer’s disease and other forms of dementia, more Americans fear being unable to care for themselves and burdening others with their care than they fear the actual loss of memory.  This data comes from an October 2012 study by Home Instead Senior Care, in which 68 percent of 1,200 survey respondents ranked fear of incapacity higher than the fear of lost memories (32 percent).

Advance planning for incapacity is a legal process that can lessen the fear that you may become a burden to your loved ones later in life.

What is advance planning for incapacity?
Under the American legal system, competent adults can make their own legally binding arrangements for future health care and financial decisions.  Adults can also take steps to organize their finances to increase their likelihood of eligibility for federal aid programs in the event they become incapacitated due to Alzheimer’s disease or other forms of dementia.

The individual components of advance incapacity planning interconnect with one another, and most experts recommend seeking advice from a qualified estate planning or elder law attorney.

What are the steps of advance planning for incapacity?

Depending on your unique circumstances, planning for incapacity may include additional steps beyond those listed below.  This is one of the reasons experts recommend consulting a knowledgeable elder law lawyer with experience in your state.

  1. Write a health care directive, or living will.  Your living will describes your preferences regarding end of life care, resuscitation, and hospice care.  After you have written and signed the directive, make sure to file copies with your health care providers.
     
  2. Write a health care power of attorney.  A health care power of attorney form designates another person to make health care decisions on your behalf should you become incapacitated and unable to make decisions for yourself.  You may be able to designate your health care power of attorney in your health care directive document, or you may need to complete a separate form.  File copies of this form with your doctors and hospitals, and give a copy to the person or persons whom you have designated.
     
  3. Write a financial power of attorney.  Like a health care power of attorney, a financial power of attorney assigns another person the right to make financial decisions on your behalf in the event of incapacity.  The power of attorney can be temporary or permanent, depending on your wishes.  File copies of this form with all your financial institutions and give copies to the people you designate to act on your behalf.
     
  4. Plan in advance for Medicaid eligibility.  Long-term care payment assistance is among the most important Medicaid benefits.  To qualify for Medicaid, you must have limited assets.  To reduce the likelihood of ineligibility, you can use certain legal procedures, like trusts, to distribute your assets in a way that they will not interfere with your eligibility.  The elder law attorney you consult with regarding Medicaid eligibility planning can also advise you on Medicaid copayment planning and Medicaid estate recovery planning.

30yr Fixed conforming rate quote (best-execution) up to 4.25%.

Mortgage rates continued higher today, after breaking a very long, very flat streak following last week's jobs numbers.  Like yesterday, today's culprit was stronger-than-expected economic data, this time from the national Institute for Supply Management (yesterday's was the regional Chicago ISM).  The losses were more pronounced, however, bringing the most prevalent 30yr Fixed conforming rate quote (best-execution) up to 4.25%.
  • Uncertainty over the Fed's bond-buying plans and more recently over Fiscal Policy has been making for a tough interest rate environment.
  • A lack of data due to the government shutdown caused rates to experience moments of paralysis while headlines suggesting the shutdown might/might-not end, as well as a seizing-up of short term funding markets caused unexpectedly high volatility--enough to be felt in longer term rates like mortgages.
  • After a deal was reached to avoid going over the debt ceiling, funding markets thawed and rates returned to the same 'wait and see' range that existed before the Fiscal drama.  
  • Markets continue to be most interested in economic data and its suggestions about the longer term trajectory of the economy.  This will shape expectations for Fed policy in the coming months, and thus inform the direction of interest rates.
  • The stronger the data the more likely the Fed is seen as reducing asset purchases.  Rates would rise under this scenario, but the most recent FOMC Meeting (and more importantly, the Fed's decision to hold off on tapering) suggests that they'll attempt to keep the pace of rising rates moderate as long as inflation isn't adversely affected.  The delayed release of the September jobs numbers on October 22nd helps confirm that.
  • (As always, please keep in mind that our Best-Execution rate always pertains to a completely ideal scenario.  There are many reasons a quoted rate may differ from our average rates, and in those cases, assuming you're following along on a day to day basis, simply use the Best-Ex levels we quote as a baseline to track potential movement in your quoted rate)....

Close of Escrow

Lots of borrowers ask me what and when is the close of escrow. Here is clear explanation. “Closing an escrow” is a term that creates much confusion for borrowers even if they are refinancing. The general term means when final papers are signed on a loan and the title is transferred to the new owner. Whether it is a purchase or a refinance, when a borrower enters into a transaction with a property an escrow is opened with a title company. An escrow office is working on the transaction at the same time as the lender is processing the loan and the real estate agent is ordering any needed inspections. The escrow officer will be receiving information both from the loan officer and the real estate agent through out the transaction period which is typically between 30 and 45 days. In addition the escrow officer will be checking on anything that affects the title of the property. Existing homeowners often wonder about why this is necessary when they already own the property but things like liens against the property have to be resolved before a transaction can close. Sometimes people don’t even realize that there is a lien against their property. The lender typically doesn’t have the final loan documents ready to send to title until somewhere between 3 and 5 days before the close of escrow. When the escrow officer receives those papers and reviews them, they then prepare the HUD I (also called the settlement) that shows the final figures involved such as whether a borrower owes any money or whether they are receiving any cash back. When the HUD I is ready the borrowers will go in to sign the final loan documents–these are the ones that will then obligate you to that loan. The timing on an escrow is critical but the lender can’t usually tell you a week in advance exactly when the signing will take place. Just be prepared that you will need to take off a couple of hours to sign those papers so you aren’t rushed. Borrowers often want to sign after work but most title companies close at 5 so their last appointment is around 4. If taking time off isn’t an option for you there are signers who can go to your home or meet you somewhere but there is an extra charge for this service which is typically $75 or more depending on the title company and where the signing is. Once signed the papers go back to the lender where the funder reviews them for conditions and/or omissions. This can take another day or two because the funder often receives a lot of files at one time and because they only fund before a certain hour in the day. When the title company receives the funds they then take the papers to be recorded and title is transferred. This is the actual close of escrow!  Michele Dillingham has been writing the First Lady of Finance™ column since 1997.
